2. Purpose

This legal notice governs access to and use of the website bodegadavidfernandez.com (hereinafter, “the website”), owned by David Fernández Bodega S.L. (hereinafter, “the winery”).

Through the website the winery provides information about its wines, its vineyards and its work, publishes articles, and allows visits and tastings at the winery to be booked. Booking those visits is additionally governed by the terms of service, which form part of this legal notice for all purposes.

Browsing the website confers the status of user and implies full acceptance of every clause of this legal notice in the version published at the time of access. If you do not agree with any of them, please do not use the website.

3. Conditions of use

Users undertake to make diligent use of the website and of the services accessible through it, in accordance with the law, this legal notice and accepted standards of conduct. In particular, they undertake not to use them to:

• Carry out unlawful activities or activities contrary to good faith and public order.
• Introduce or distribute content that infringes human rights, the dignity of individuals or the protection of children and young people.
• Cause damage to the systems of the winery or of third parties: introducing viruses or any other malicious code, attempting to access restricted areas, or making mass automated requests that may disrupt the normal operation of the site.
• Provide false details, details of third parties without their authorisation, or impersonate another person, particularly in the booking form.
• Systematically extract the contents of the website, by any means, in order to reuse them elsewhere.

The winery may refuse or withdraw access to the website, without prior notice and without any right to compensation, to anyone who breaches these conditions.

4. Legal drinking age and responsible consumption

This website provides information about alcoholic beverages and allows activities that include tasting them to be booked. Its content is aimed exclusively at people over the age of 18, and only people of that age may make a booking.

The sale and supply of alcoholic beverages to minors is prohibited. Minors may accompany a responsible adult during visits, but under no circumstances will they be served wine. The winery recommends moderate and responsible consumption, and not driving after a tasting.

5. Intellectual and industrial property

All the contents of the website — texts, articles, photographs, plot illustrations, label design, source code, graphic design, navigation structure and databases — belong to the winery or to third parties who have authorised their use, and are protected by Spanish and European intellectual and industrial property law.

The trade marks, trade names and distinctive signs appearing on the website belong to their respective owners, and their presence does not imply any assignment of or licence over them.

Their reproduction, distribution, public communication, transformation or any other form of exploitation without the express written authorisation of the winery is prohibited. Viewing, downloading and printing content is permitted for personal and private use, with no commercial purpose, provided that authorship notices are not altered or removed.

6. Links to other sites

The website includes links to third-party pages; among them, the record for each wine hosted at codigoqrvinos.es, which is the service where we publish our electronic label information. Those links are offered purely as a convenience for the user.

The winery neither manages nor controls those sites, is not responsible for their content, their availability or their privacy practices, and recommends reading their own terms before using them. If, on becoming aware of unlawful content on a linked site, the winery does not remove the link, it will assume the responsibility corresponding to it under the LSSI.

Linking to this website requires prior authorisation, does not authorise reproducing its contents or presenting them within another page, and does not imply any relationship between the winery and the owner of the linking page.

7. Disclaimer

The winery works to keep the information on the website correct and up to date, and to keep the service running without interruption, but it cannot guarantee the complete absence of errors or the permanent availability of the site.

To the extent permitted by law, the winery is not liable for damages arising from:

10. Applicable law

This legal notice is governed by Spanish law. For the resolution of any dispute arising from access to or use of the website, the parties submit to the courts and tribunals that are competent under the law; where the user is a consumer, these will be those determined by consumer protection legislation, without this clause limiting in any way the rights that the law grants them.
