These conditions govern the booking of our visits and tastings through bodegadavidfernandez.com. We have written them so that you know in advance what the experience includes, what happens if you cannot come, and what we expect of you during the visit.
1. Purpose and acceptance
These conditions govern the booking of the wine tourism experiences — visits, tastings and any other activity we publish — offered by David Fernández Bodega S.L. through the website bodegadavidfernandez.com.
By confirming a booking you declare that you have read and accepted these conditions in the version published at that moment, together with the legal notice and the privacy policy.
2. Who can book
Only people over the age of 18 with legal capacity to contract may book. Whoever makes the booking is responsible for the accuracy of the details provided and acts on behalf of the whole group, and therefore undertakes to pass these conditions on to the rest of the party.
Minors may accompany the group provided they come with a responsible adult, and this should be indicated when booking. Under no circumstances will they be served alcoholic drinks.
3. How a booking is made
The process is the same for every experience:
- You choose the experience, the date and the time from those available in the calendar.
- You state the number of people and provide your contact details.
- You confirm the booking.
The booking is complete when you receive the confirmation email with your code — in the form BOD-XXXXXX — which is sent immediately. That email is your booking receipt; please have it to hand on the day of the visit. If it does not arrive within a few minutes, check your spam folder, and if it still does not appear, write to us: there is probably a mistake in the address given.
Places are limited and allocated in order of confirmation. We work with small groups, up to the maximum capacity per session stated for each experience, and bookings can only be made within the advance period shown in the calendar.
4. Prices
The price of each experience is shown per person on its page and in the booking summary, and includes applicable taxes (IGIC). The total is that price multiplied by the number of attendees, less any discount code you have applied.
The applicable price is the one shown at the moment the booking is confirmed; later changes to our rates do not affect bookings already confirmed. Each experience states what it includes — the route, the duration and the wines in the tasting; anything not listed there is not included, and in particular travel to the winery and the purchase of bottles are not.
5. Payment
Booking through the website requires no advance payment and no bank details: the price of the experience is paid at the winery on the day of the visit, before it starts. At that point the corresponding receipt or invoice is issued, which you can request in a company's name by providing its tax details.
If we enable online payment in the future, the applicable conditions will be set out within the booking process itself, before it is confirmed.
6. Discount codes and vouchers
If you have a discount code or a voucher, you can enter it at the last step of the booking so that the amount is recalculated before you confirm. Codes are personal, cannot be exchanged for money and cannot be combined with one another unless stated otherwise, and are subject to the validity date, the experience and the conditions of use stated on each one.
We reserve the right to cancel a code obtained or used fraudulently, as well as the booking to which it was applied.
7. Changes and cancellations on your side
We completely understand that plans change. You can cancel your booking at any time before the visit, with no minimum notice, from the link in your confirmation email or by writing to us at info@bodegadavidfernandez.com quoting your booking code. To change the date, the time or the number of people, write to us at that same address.
As payment is made at the winery, cancelling a booking carries no cost for you. If you can let us know in good time, we appreciate it: we prepare each session for the specific group expected, and that way we can offer the place to someone else. Any change that increases the number of attendees is subject to there being free places in that session.
8. Changes and cancellations on our side
Exceptionally we may have to change or cancel a session: because of adverse weather — much of the visit takes place outdoors, in the vineyard —, because of urgent harvest or cellar work, because of staff illness, or for reasons of force majeure.
In that case we will let you know as soon as possible by email or telephone and offer you an alternative date. If none suits you, the booking is cancelled at no cost; if you had paid any amount in advance, it would be refunded in full. We may also adapt the route — for example, replacing the vineyard section with another one indoors — while keeping the essence and the duration of the experience.
9. Punctuality and no-shows
Visits start at the time booked. We recommend arriving ten minutes early: groups are small and a late arrival affects everyone else. If you are running late, call us and we will do our best to bring you into the group, although we cannot always make up the part already covered or extend the session.
Fifteen minutes after the start time, if you have not arrived and we have not heard from you, we may treat the booking as a no-show and release the places.
10. Right of withdrawal
As a general rule, consumers have fourteen days to withdraw from contracts concluded at a distance. However, article 103 of the consolidated text of the Spanish General Act for the Defence of Consumers and Users (Royal Legislative Decree 1/2007) excludes from that right contracts for leisure services to be provided on a specific date or during a specific period, which is exactly the case of a visit booked for a particular day and time.
The right of withdrawal therefore does not apply to these bookings. That does not prevent you from cancelling your booking under section 7, which is free of charge.
11. How the visit works
The visit goes through a working agricultural setting: uneven ground, loose volcanic ash, stone walls and slopes. We ask you to wear closed, comfortable footwear and to bear in mind the sun and the wind, which in Lanzarote are part of the landscape.
During the activity it is necessary that you:
- Follow at all times the instructions of the person guiding you.
- Do not enter the working areas, the machinery or the tanks.
- Supervise any minors with you, who remain your responsibility.
- Do not smoke inside the facilities or among the vines.
We may interrupt the visit and ask anyone to leave the premises if they disrupt it, put their own safety or that of others at risk, or are disrespectful to staff or to the rest of the group, with no right to a refund.
The tasting involves consuming alcohol and is voluntary: you can take part in the visit without drinking, and we always offer water. Please remember not to drive after drinking; if you are coming by car, decide beforehand who is driving.
If anyone in the group has allergies, intolerances, a relevant medical condition or needs accessibility support, tell us in the comments field of the booking or call us, and we will adapt whatever is within our reach.
12. Liability
The winery is liable for the proper provision of the experience booked, on the terms laid down by consumer protection legislation. It is not liable, however, for damages arising from failure to follow the safety instructions, from wearing inadequate footwear or clothing, from conditions not disclosed in advance, or from the reckless behaviour of attendees.
Nor is it liable for personal items you may lose or leave behind during the visit, although we will do our best to return them to you if they turn up.
13. Complaints
If something has not gone as you expected, tell us first: write to us at info@bodegadavidfernandez.com with your booking code and we will try to resolve it as soon as possible. It is almost always the fastest route.
As an establishment open to the public we hold official complaint forms from the Government of the Canary Islands available to consumers. You may also address your complaint to the municipal consumer information offices or to the Directorate-General for Trade and Consumer Affairs of the Government of the Canary Islands.
14. Changes and applicable law
We may update these conditions to adapt them to our activity or to regulatory changes. Each booking is governed by the conditions in force at the moment it was confirmed, which you can keep together with your confirmation email.
These conditions are governed by Spanish law, in particular by Royal Legislative Decree 1/2007 (defence of consumers and users) and Act 34/2002 (information society services). For the resolution of any disputes that may arise, the competent courts will be those determined by the applicable consumer protection legislation, without prejudice to the rights that the law grants the consumer.
This is a courtesy translation. In case of any discrepancy, the Spanish version prevails.
